PRIVACY POLICY FOR JOB APPLICANTS
Preamble
PhDr. Miroslav Hofírek, sole proprietor, ID: 11386568, registered office at Kolová - Háje 60, 360 01 Karlovy Vary (hereinafter "HOFÍREK CONSULTING" or "we"), is authorized to operate:
- an employment agency focused on finding employees for employers seeking new staff;
- to provide consulting and information services in the field of employment opportunities.
HOFÍREK CONSULTING conducts its business through independent offices located in Prague, Brno, Hradec Králové, Ostrava, Karlovy Vary, and Bratislava.
In the course of its business activities, HOFÍREK CONSULTING processes personal data of job applicants. This Privacy Policy for Job Applicants (hereinafter "Policy") provides you with information on how HOFÍREK CONSULTING processes the information you provide in connection with the job placement process.
We may also ask for your explicit consent regarding the collection and processing of certain types of your data, as specified below in this Policy.
HOFÍREK CONSULTING hereby declares that all personal data is processed in accordance with the data protection laws valid in the Czech Republic and with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (GDPR).
1. Controller
The controller is responsible for compliance with the obligations set out in the GDPR for the processing of personal data. The controller is HOFÍREK CONSULTING.

2. What specific personal data does HOFÍREK CONSULTING process?
HOFÍREK CONSULTING processes personal data to the extent of the biographical data provided in your CV or related relevant supplementary information you provide during the selection process. Typically, this includes the following personal data:
- Identification data: name and surname, address, telephone number, email address, and possibly other contact details;
- Data related to the job application: CV, cover letter, education, skills, abilities, experience, previous work experience, qualifications, etc.;
- Preferences: e.g. preferred place of work, preferred job position, preferred salary, interests you choose to share with us voluntarily;
- Appearance: photograph only voluntarily;
- Reference providers: reference letters, names and contact details of persons providing them. If you decide to attach references to your job application, it is your duty to obtain their consent and inform them of the purpose for which their personal data may be processed by us (based on this Privacy Policy for Job Applicants) before providing us with their personal data. We will not contact your reference providers directly unless you give us your explicit consent to do so.
- Special categories of data: information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, genetic data, biometric data for the purpose of uniquely identifying a natural person, and data concerning health, sexual life, or sexual orientation. Please do not provide such personal data.
You may choose what types of information you provide in your job application. To assess your application for a specific position, it is usually necessary to provide the information listed under i), ii), and iii). If you choose not to provide this data, we may not be able to process your application further. In some cases, the job offer may specify additional categories of data required for the specific position. In such cases, providing such information will also be considered mandatory (please read the job offer carefully). Providing any other information is entirely up to you and will be considered voluntary.
3. Purpose of processing personal data
HOFÍREK CONSULTING processes the personal data you provide during the selection process for the purpose of reviewing and assessing your suitability as a candidate for a specific job position and job placement, for the provision of services directly related to job search or placement, and for compliance with legal and internal regulations, in particular for the following purposes:
- assessment of your suitability and qualifications in relation to our job opportunities, maintaining a relationship with you during the selection process, i.e. calling you and inviting you to interviews, negotiating offers and employment conditions with you, etc.;
- verification of your information and references / previous education and experience (if required by law or with your explicit consent);
- communication with you and to inform you about other job opportunities (if we have your consent to include you in our personnel database, see below);
- defense in possible legal and court proceedings.
If in the future we need to process your personal data for a purpose other than those listed above, we will inform you of this purpose and provide you with all other relevant information. In necessary cases, we may request your consent before processing your personal data for another purpose.
4. Legal basis for processing
The legal basis for processing your personal data is in particular:
- your consent to process all personal data provided in your CV and related information you have provided to us in connection with your decision to apply for our job offer and send us your CV and related documentation after reading this Privacy Policy;
- the possible need to establish a contractual relationship with you or to take measures at your request in this regard;
- fulfillment of legal obligations related to the selection process;
- the legitimate interest of HOFÍREK CONSULTING to carry out the business activities specified above in full, including ensuring that HOFÍREK CONSULTING, its computer networks, and information are secure, management and administration of HOFÍREK CONSULTING, protection of our interests and rights in the event of an investigated, alleged, or actual violation of legal regulations;
- your voluntarily given consent to the processing of your personal data.
5. What is included in the consent to the processing of personal data
Consent is your voluntarily provided written confirmation that HOFÍREK CONSULTING is authorized to process your personal data for the specified purposes. Your consent to the processing of personal data may be withdrawn at any time. To withdraw your consent, please send an email to: gdpr@hofirek.cz. Once we receive your withdrawal request, all data to which your withdrawal relates will be deleted from our records. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
6. Automated decision-making
Automated decision-making, including profiling, is not applied during the selection process for applicants.
7. Who is the recipient of personal data
Your personal data will be accessible to the relevant consultants of HOFÍREK CONSULTING for the above purposes, who are bound by confidentiality obligations. The recipients of your personal data are clients of HOFÍREK CONSULTING as potential future employers. HOFÍREK CONSULTING guarantees that your personal data will only be made available to these third parties with your prior consent. In this context, HOFÍREK CONSULTING has taken appropriate protective measures to ensure that these third parties, as processors of your personal data, fulfill their obligations regarding the protection of your data and have also implemented appropriate technical and organizational measures to secure your data. Data processors have the same obligations to protect your personal data in accordance with the GDPR as HOFÍREK CONSULTING.
8. Retention period of personal data
HOFÍREK CONSULTING retains your personal data until the relevant job position is filled. We assume that this period will not exceed 6 months. Once this period ends, all your personal data provided during the selection process will be deleted, unless you have given us your consent to keep your data in our personnel database for future selection procedures. In such a case, please fill in the consent form that we will provide to you separately. After the period for which separate consent was given expires, all information about your personal data will be destroyed, i.e. deleted and shredded.
9. Rights of data subjects
Since HOFÍREK CONSULTING, as the controller, processes your personal data, you have the right:
- to access personal data;
- to rectify inaccurate or incomplete personal data;
- to erase personal data if it is no longer needed for the purposes for which it was collected or otherwise processed, or if it is found to have been processed unlawfully;
- to restrict the processing of personal data in special cases;
- to data portability;
- to object, for reasons related to your particular situation, to the processing of your personal data based on our legitimate interest. In such a case, the processing of personal data will be terminated unless it is demonstrated that there are compelling legitimate grounds for the processing which override your interests or rights and freedoms, in particular if the reason is the possible enforcement of legal claims;

To exercise your rights, you may send a written request with the date and your signature to the following address: HOFÍREK CONSULTING, T. G. Masaryka 883/53, 360 01 Karlovy Vary, to the attention of Miroslav Hofírek, or to the e-mail address gdpr@hofirek.cz. Your request will be considered and you will receive a response within one month.
10. Security of your data
HOFÍREK CONSULTING takes appropriate technical, organizational, and legal measures to protect information related to the job application, including secure servers, firewalls, and encryption of the data provided in the application.
